What is Fair Wear and Tear?
Definition
Fair wear and tear is the reasonable deterioration of a property and its contents through normal everyday use over the course of a tenancy — such as carpet wear in walkways, minor scuffs and faded paint — which a landlord cannot charge a departing tenant for.
The dividing line is use versus abuse: a worn carpet path is wear and tear, a wine stain is damage; faded curtains are wear and tear, a torn curtain is damage; small picture-hook holes are usually wear and tear, children's drawing on walls is chargeable redecoration.
The standard works like a car lease: the tenant returns the property in the condition they received it, allowing for normal ageing. In Lincoln check-outs, the most common legitimate charges are dirty ovens and extractors, and limescale-covered showers — dirt is never wear and tear.
